Officer Porter’s Defense Attorneys Call for a Mistrial in Freddie Gray Case

Warren S. Alperstein appeared in an ABC2 News video regarding the status of Officer William Porter’s trial in the death of Freddie Gray. Officer Porter’s defense attorneys called for a mistrial after the prosecution failed to disclose information regarding previous conversations Freddie Gray had with police officers about a back injury.

“This is not an obscure rule or theory of evidence. This is the most common, basic, understood theory of evidence in criminal law,” Mr. Alperstein said. “There is no excuse for the prosecution to withhold evidence that may negate the guilt of a defendant.”

However, Judge Barry Williams denied the request for a mistrial, and testimony will continue.
