How Will Officer Porter’s Mistrial Affect the Case’s Future Trials?
Warren S. Alperstein was quoted in a recent ABC2 News article about the impact Officer Porter’s mistrial will have on the trials for the other five officers charged in connection with the death of Freddie Gray. The next trial is set for Officer Caesar Goodson, the driver of the van that transported Freddie Gray, which is scheduled to commence on January 6, 2016.
Prosecutors had planned on Officer Porter testifying, but since his trial is still pending, he has the right to refuse to testify if it would incriminate himself. “He has that privilege because he’s [Officer Porter] a defendant, pending a trial, therefore Officer Porter is taken out of the mix,” said Mr. Alperstein.
