Impact of Officer Porter’s Mistrial on Officer Goodson’s Upcoming Trial
Warren S. Alperstein was quoted in a recent article published by The Greyhound regarding the anticipated outcomes of Officer Caesar Goodson, Jr.’s trial for charges in connection with the death of Freddie Gray. Prosecutors had planned on having Officer Porter testify in Officer Goodson’s trial, but since Officer Porter’s trial was rescheduled for June 13, 2016 after a declared mistrial, he can invoke his Fifth Amendment right, which allows him to refuse to testify in order to avoid self-incrimination.
Mr. Alperstein noted, “I don’t know how the state proves [police van driver] Officer Goodson was aware Freddie Gray needed a medic without Porter’s testimony.”
